    insurance help

    my mate down south has his escort cossie stolen out of his ex girlfriends garage, the car was in her name and she claimed on her insurance for it, apparently (according to her) she didnt get paid out for it, is there any way my mate can find out if they did actually refuse to pay out on it as he has a sneaking suspicion she did or is there any way that he can find out which if any insurance company has any interest/claim to the vehicle should it be recovered.

    this happened 3 or 4 years ago but someone has recently told him that she did get paid and kept the cash for herself

    He could get an HPI check done on the car which should show a Stolen Car marker and the contact information for the insurance company. If the car is/was recovered and she had been paid out, the insurance company will own the vehicle.

    But as Tiggs said, if it's in her name and she took out the insurance, she's not done anything illegal.

    the car was never recovered, they moved 7 cars to get it out of the lock up it was in, and i know technically she has done no wrong but moraly she has, im sure if you fell out with someone and your car was stolen and your ex claimed and kept the cash you would be as pissed off as he is.

    If it was my car tbh I'd never have registered it in anyone elses name unless I was married.

    It may be underhand but then she would have letters repudiating the claim if it wasnt paid out for whatever reason.

    My ex took loans and credit cards out in my name online and never told me about them. I'm still paying off the almost £15k he racked up but I'm not whinging about it though. I was foolish to trust him with personal information and compared to the physical and mental abuse he gave me, I've got off lightly...................

    If it were 'in her name' as in she was on the logbook that doesn't mean she was the legal owner. For instance I bought my wifes car but its in her name on the log book, though i am still the legal owner. Most people think that whoever is on the logbook owns the car legally, that isn't the case.

    If he bought the car and only had it registered and insured in her name - not given her the car, and she has pocketed the payout, wells thats theft.

    thats what he is trying to find out, weather she has actually been paid out or not before he does anything.

    Is the person named on the V5 not the legal owner and keeper of the car hence the reason for a V5? (Married couples are different )

    Absolutely not - including married couples, unless you're talking about the 50/50 entitlement of property in the case of a divorce. The V5 is purely a document of who is the registered keeper of the vehicle

    Receipt of payment that you paid for it

    If you then gift it to someone you then transfer the legal ownership, but it would be up to the receiver to prove it.

    Yup, when you buy a new car on a finance plan, it is they who are the owner of the vehicle until you have paid them back for it.

    Your name will appear on the V5C though as you keep and run the vehicle, and so will get any information about the vehicle that is relevant to you.
